Welcome to Azizam! By registering for or using Azizam, a Persian dating platform designed to help you connect with like-minded individuals, you agree to abide by the following Terms and Conditions. These terms govern the use of both our website and mobile application, and by accessing or using any part of our services, you are agreeing to comply with these terms.

Please read these Terms carefully, as they outline your rights, obligations, and responsibilities as a user. If you do not agree to these Terms, you should not use or access Azizam.

Important notice: Azizam does not conduct criminal background checks on its users.

1. Introduction

Azizam is a service provided by Inno Lynx UG (Hasbachtal 120, 33619 Bielefeld, Germany), and is designed for individuals aged 18 and older. This service allows users to create profiles, connect, and communicate with other users based on shared interests and preferences.

These Terms apply to all users of the Azizam platform, regardless of whether they access the service through a mobile app or web browser.

2. Agreement to the Terms

By registering an account or using Azizam, you agree to be bound by these Terms and our Privacy Policy. These documents constitute the entire agreement between you and Azizam.

3. Contract Conclusion
   1. The contractual relationship between Azizam and the User is established when the User successfully registers for an Azizam account.
   2. Registration is free and can be completed by filling out the registration form. Alternatively, users may register via third-party services such as Google, Apple, Telegram, or Facebook. In such cases, certain data from the User’s third-party profile will be transferred to and stored in Azizam’s database. By using third-party features, the User agrees to the terms of the respective third-party provider and consents to the transfer and storage of selected data in Azizam’s database.
   3. Azizam reserves the right to deny registration based on objective criteria. Such criteria include, but are not limited to, violations of the Terms of Use, fraud prevention measures, uncertainty regarding the User’s identity, suspicion of spam, concerns about the User’s age, potential deception, or attempting to register in regions where Azizam is not available. Azizam may require additional steps, such as identity verification or anti-spam measures, as part of the registration process.
   4. Access to the Azizam platform is free and supported by advertising. Users can unlock additional paid features by purchasing them or subscribing to a plan.
   5. Each individual is permitted to create only one user account. If an existing account exists, it must be deleted before a new account can be registered. Users who have been blocked by Azizam are prohibited from re-registering or creating multiple accounts.
   6. Azizam’s services are strictly available to individuals who are 18 years of age or older, regardless of the legal age of majority in other regions.
   7. Individuals who have been convicted of sexual offenses or are listed as sex offenders (including offenses under Sections 174 to 180 or Section 182 of the German Criminal Code (StGB) or Sections 180a, 181a, 183 to 184g StGB, or other relevant statutes for the protection of minors) are strictly prohibited from using the service.
   8. Azizam does not conduct criminal background checks on its users.

4. Azizam Services
   1. The “Matching” feature (referred to as “Match”) presents Users with profiles that align with their specified search criteria (e.g., age, gender) and are located within the User’s preferred distance range based on their current location.
   2. Azizam reserves the right not to deliver messages if there is reasonable suspicion that they violate the Terms of Use or are abusive in nature. In particular, Azizam is under no obligation to deliver unsolicited advertising messages or other suspicious communications, as defined by our guidelines.
   3. Azizam may modify the features and functionality of the platform at any time.
   4. Azizam strives to ensure the platform is accessible and available to the fullest extent possible. However, Users acknowledge that there will be occasional downtimes due to maintenance, software updates, and factors beyond Azizam’s control (such as force majeure or issues caused by third parties). During these times, access to the service may be temporarily unavailable.
   5. If Azizam becomes aware of any technical issues or malfunctions, the company will make every effort to resolve them as quickly as possible within regular working hours in Germany (Monday to Friday, 09:00 AM to 06:00 PM, excluding public holidays where Azizam is headquartered). If an outage or significant malfunction cannot be resolved within 48 hours, Azizam will notify Users via email with an estimated time for resolution.
   6. To use the full range of Azizam’s features, Users must ensure they are using up-to-date technology on their devices, including modern browsers with JavaScript, cookies, and pop-ups enabled, and the latest versions of Android or iOS. Users with outdated or unsupported technologies may experience limited functionality when accessing the platform.
   7. If Azizam provides updates to the platform, Users are strongly encouraged to install these updates promptly. It is the User’s responsibility to implement such updates in a timely manner. Failure to do so, after being informed by Azizam of the availability and importance of the update, may result in product defects, for which Azizam will not be held liable. If the User experiences issues with the installation of updates, they must notify Azizam immediately.

5. Cancellation of the User Account
   1. Users may cancel their account at any time without the need to observe a notice period.
   2. To cancel an account, Users can either delete their account via the “Delete Account” option available in the Account settings within the mobile app, or by submitting a cancellation request in text (e.g., email) or written form (e.g., letter). When requesting cancellation, Users must provide sufficient identifying information, such as the email address or phone number associated with their account, to allow Azizam to accurately match the request to the correct account. Failure to provide this information may prevent account cancellation.
   3. Upon cancellation or deletion of the account by the User, any active fee-based features will immediately expire.
   4. Azizam reserves the right to terminate a user account with a standard notice period of two weeks. Azizam also retains the right to terminate an account immediately for good cause, such as serious or repeated violations of the Terms of Use.
   5. Azizam will provide account termination notices in text or written form.
   6. If Azizam terminates an account for reasons not attributable to the User, the User will be entitled to a refund for any unused or unconsumed fee-based features associated with the account.
   7. Additionally, if a User remains inactive (i.e., does not log in) for a period of 60 months, the account will be automatically terminated, and all associated data will be deleted in accordance with Azizam’s Privacy Policy.

6. Fee-based Services, Subscriptions, and Virtual Goods
   1. Users can purchase various fee-based features (“Fee-based Features”) through the mobile apps or website. These include, but are not limited to, subscriptions and virtual goods, such as in-app credits or gifts.
   2. Some fee-based features may be offered for a fixed term and are typically linked to the User’s account.
   3. The price of each Fee-based Feature will be clearly displayed to the User prior to purchase, along with the applicable terms.
   4. Users residing outside the European Union may only purchase fee-based features in their country of residence, while those residing within the EU may only purchase within the Union.
   5. Subscriptions are a recurring fee-based service, charged at the time of subscription and at the start of each billing cycle unless canceled. The price and billing period will be displayed before placing the order and provided in a confirmation email.
   6. Either party may cancel a subscription with 24 hours’ notice before the end of the current billing period. Special cancellation policies may apply depending on the User’s location, allowing for early termination or refunds. Details are available on the support pages of Apple (https://getsupport.apple.com/) or Google (https://support.google.com/googleplay/).
   7. Canceling a subscription does not affect the User’s account, though access to subscription-specific features will be revoked.
   8. Subscriptions purchased through the Apple App Store must be canceled through Apple, as Azizam is unable to process cancellations or refunds for these purchases.
   9. Subscriptions purchased through other payment providers can be canceled via the provider or by contacting Azizam in text (e.g., email) or written form. Users must provide the order or transaction number associated with the subscription, found in the confirmation email or payment provider account.
   10. Azizam reserves the right to terminate a subscription without notice for significant reasons, such as insolvency proceedings, severe violations of the Terms of Use, or the use of the account for illegal activities. In such cases, the User may be liable for any resulting losses.
   11. Virtual goods, which may be permanent or consumable, are available for purchase via the website or apps. These goods are linked to the User’s account and cannot be transferred to other Users.
   12. Upon purchasing virtual goods, such as credits, they become associated with the User’s account and can be used within the app or website to activate specific features, effects, or gifts.
   13. If a User deletes or cancels their account, any virtual goods linked to that account will be permanently lost and cannot be recovered.

7. Guidelines

The purpose of these Guidelines is to ensure that the Azizam platform is a pleasant and safe environment for all users. These rules serve as a guide for appropriate behavior and conduct across all features of our platform, including profiles, chats, and the matching feature.

We expect all users to interact with one another in a respectful and fair manner. While users have the right to express themselves and showcase their personalities, this right ends when it infringes upon the rights of others or violates legal standards. Additionally, there are basic principles of conduct that Azizam, as the platform provider, requires to ensure a fair and positive dating experience.

Azizam does not tolerate any illegal or inappropriate content. Below, we outline the key rules and provide an overview of content and conduct that are prohibited on our platform:

1. Minors and Images of Minors
   The platform is strictly for users aged 18 and older. Any use by minors is prohibited. Content, especially images, showing minors (under 18) in profile pictures is not allowed.
2. Appropriate Profile and Gallery
   Images must meet the standards set by these Guidelines to ensure an authentic and satisfactory dating experience. Profile photos should reflect the user accurately, and all images must be of good quality, with sufficient resolution and lighting. The following are prohibited:
   1. Screenshots, photos of screens, or images of photos.
   2. Images created or modified using AI, filters, or similar technical means.
   3. Images showing alcohol, cigarettes, hookahs, or other substances.
   4. Reusing images across different profiles.
   5. Group photos as profile pictures.
   6. Profile pictures where the face is obscured by hair, hats, phones, sunglasses, or other objects.
   7. Text in profile pictures.
   8. All individuals in the photos must have consented to their appearance.
3. Non-Authentic Verification Photo
   As part of Azizam’s commitment to ensuring an authentic dating experience, users are required to submit a “verification photo” for internal review. This photo is not published on the platform. It must be genuine and match the profile picture, with no alterations via AI, filters, or other technical means. If the verification photo does not meet these requirements, it will be rejected, and the profile may be blocked. The verification photo must be clear, well-lit, and show the user’s full face, with handwritten required information clearly visible. Additionally, users may only have one profile, and reusing a verification photo across multiple profiles is prohibited.
4. Identity Fraud, Fraudulent Behavior, and Improper Use
   Fraudulent behavior and content are strictly prohibited on the Azizam platform. This includes any attempt to mislead other users by presenting false information or creating deceptive content for personal gain, whether or not it involves money. It is unacceptable to deceive other users with false information to gain an advantage in finding a partner or for any other purpose. This rule applies to both automated bots, which are banned on the platform, and individual users. This prohibition covers, but is not limited to:
   1. Impersonating a false identity, providing false information (such as creating multiple profiles or using “fake profiles”), or fabricating financial distress to solicit money or other benefits (e.g., romance scams, marriage scams).
   2. Engaging in fraudulent activities to acquire free memberships through the systematic creation of new profiles.
   3. Conducting offensive searches related to sexual adventures, affairs, surrogacy, or sperm donation, which are also violations of these guidelines.
   4. Repeated contract revocations (“multiple revocations”) within three months, especially when related to the use of paid services, are deemed unreasonable behavior.
5. Advertising and Spam
   Azizam is a platform designed solely for dating and relationship-building. Using the platform for other purposes, such as advertising or spamming, is strictly prohibited. Users are not permitted to promote products, services, or other platforms. The following activities are banned:
   1. Posting messages, images, or profile entries intended to advertise goods, services, or other platforms.
   2. Including personal contact information such as full names, addresses, phone numbers, social media accounts, email addresses, or membership statuses in profile entries, text, images, or chat messages.
   3. Requests for contact information.
   4. Posting job offers, opportunities to earn money, or advertisements for goods and services.
   5. Soliciting or directing users to other platforms or social networks.
   6. Advertising contests, giveaways, lotteries, or gambling.
   7. Sending an excessive number of initial messages, copy-and-paste messages, chain letters, or messages via video chat at an inappropriate frequency.
6. Activities against IT and Data Security
   Any actions or attempts by users or automated systems (bots) that jeopardize the IT security of the Azizam platform or compromise user privacy are strictly prohibited. The protection of user data is a top priority for Azizam. Specifically, the following activities are not allowed:
   1. Automatically registering accounts or posting content in a systematic, programmatic manner.
   2. Uploading or transmitting malicious software, viruses, malware, or any other harmful code, files, or programs.
   3. Harvesting data or employing similar data extraction techniques.
   4. Sending phishing messages to other users.
   5. Engaging in activities that affect the availability of the platform for other users, such as overloading the servers with non-conventional data transfers.
   6. Registering bots or using automated mechanisms, as well as any activities carried out by such systems.
   7. Intercepting emails or messages intended for other users.
7. Hate Speech, Racist, and Terrorist Content
   Azizam does not tolerate any form of hate on the platform. Content that incites or displays violence or hatred against individuals or specific groups based on characteristics such as ethnic origin, religion, disability, age, nationality, sexual orientation, gender identity, immigration status, or any attributes associated with discrimination is strictly prohibited. Examples of prohibited content include:
   1. Statements suggesting that certain groups (e.g., religious communities) are inhuman, inferior, or deserving of hatred.
   2. Content aimed at convincing others to hate or discriminate against individuals based on group affiliation.
   3. Materials, symbols, or behaviors associated with groups that conflict with constitutional values or democratic principles (e.g., swastikas).
   4. Right-wing or left-wing extremist content and politically extreme statements.
   5. Content that glorifies or incites acts of terrorism, violence, or terrorist regimes.
   6. Party political content.
   7. Content that incites violence, killings, or the commission of crimes.
8. Insults and Defamation
   While freedom of expression and tolerance are valued on the platform, there are limits. Any content that is offensive, humiliating, defamatory, threatening, or degrading to a religious denomination, or that constitutes libel, is not permitted. Examples of prohibited behavior include:
   1. Insulting or defamatory remarks toward other users.
   2. Spreading untrue or defamatory statements about a third party.
   3. Threats of violence or crime against another user or their family members.
   4. Insulting or derogatory remarks about religious or ideological groups.
9. Child Pornography and Child Abuse
   Azizam strictly prohibits any content related to child pornography or the abuse of children. Any such content will immediately be reported to law enforcement and relevant authorities. This includes any material that incites, depicts, or references child abuse.
10. Child Endangerment and Sexual Exploitation
    Any content that sexualizes minors (under 18) or promotes the sexual exploitation of children is strictly forbidden. Azizam will report such content to the appropriate authorities. Prohibited activities include:
    1. Visual depictions of minors in sexually explicit or suggestive acts.
    2. Computer-generated or other representations of minors in a sexually explicit context.
    3. Links to external content involving the sexual exploitation of children.
    4. Expressions of interest in material related to the exploitation of minors.
    5. Soliciting minors for commercial sexual acts or engaging in acts related to their exploitation.
    6. Identifying child victims of sexual exploitation by name or image.
    7. Recruiting vulnerable individuals, including those under 21, for prostitution or slavery.
11. Pornographic and Sexualized Content
    Pornographic and sexualized content are not allowed on Azizam. Our goal is to maintain a respectful and enjoyable dating environment for all users. Prohibited content includes, but is not limited to:
    1. Any content depicting sexual acts or pornography in any form.
    2. Nudity intended to sexually arouse others, such as images where genitals, buttocks, or breasts are partially or fully exposed or shown in close-up.
    3. Suggestive poses or overly revealing clothing.
    4. Depictions of sex toys or offensive fetishes, including any form of infantilism.
    5. Content that involves or encourages necrophilia, bestiality, or similar acts, including depictions of such acts with human- or animal-like beings or avatars (e.g., hentai, anime, or other digital forms of animation).
    6. Sexualized communication, such as “sexting,” and the solicitation of sexual acts, escort services, or similar services in exchange for monetary or non-monetary compensation.
    7. Simulated sexual acts offered in exchange for payment.
12. Inappropriate, Offensive, and Vulgar Content
    Content that is offensive or vulgar, even if not explicitly pornographic, is also prohibited on the platform. This includes:
    1. Profanity, insults, and inappropriate language, whether expressed through text, emojis, images, or gestures.
    2. Graphic or glorified depictions of violence, including scenes of death, torture, injuries, surgical procedures, blood, or bodily fluids. This also applies to depictions involving human- or animal-like creatures or avatars.
    3. Images or descriptions of accident scenes, exposed internal organs, broken bones, and severe physical injuries.
    4. Content that promotes fear or prejudice against a group of people, such as claims that a group is involved in illegal or dangerous activities (e.g., “all are terrorists”).
    5. Racist, sexist, or derogatory terms, slurs, or expressions.
    6. Content that humiliates or directs negative stereotypes toward specific users, individuals, or identifiable groups.
    7. Denial of significant tragic events (e.g., the Holocaust or the 9/11 terrorist attacks).
    8. Insensitive remarks regarding death by suicide, overdose, or other causes affecting real people or identifiable groups.
    9. Anti-gender or homophobic behavior.
    10. Begging for money or other forms of benefit.
13. Dangerous Activities or Products
    Content related to dangerous activities or products is prohibited on Azizam, as such content is unrelated to the dating experience and poses risks to user safety. Specifically prohibited content includes:
    1. Activities or products objectively classified as dangerous
    2. Content featuring explosives, firearms, other weapons (e.g., paintball guns, bows, knives), military equipment, or dangerous tools.
    3. Depictions of illegal intoxicants or narcotics, including drug paraphernalia, alcohol abuse, or other mind-altering substances.
    4. Content that promotes or encourages self-harm, eating disorders, or suicidal behavior.
14. Illegal or Inappropriate Goods and Services; Prostitution and Gambling
    Azizam strictly prohibits content related to illegal or inappropriate goods and services, including prostitution and gambling. This includes:
    1. Human trafficking.
    2. Prostitution or other sexual services.
    3. Illegal gambling.
    4. The sale of illegal goods or drugs. The legality of goods and services depends on the applicable laws between the user and Azizam.
15. Content that Infringes Copyright and Other Industrial Property Rights
    All users must have the legal right to use the content they post on Azizam. This includes respecting copyrights, trade secrets, patents, and trademarks. Content may be lawful if the rights holder consents, and the user can prove this when required.
16. Violations of User Privacy
    Respecting the privacy of other users is essential for fair communication on the platform. Users must not share personal information (e.g., photos) without permission. Violations of privacy include:
    1. Posting images of others without their consent.
    2. Sharing voice recordings or private chats involving others.
    3. Sharing nude images of others or publishing their contact information without consent.
17. Depiction of Violence
    Azizam prohibits any form of violence or content depicting violence against humans, human-like creatures, or animals. Prohibited content includes:
    1. Graphic or gory material, such as death, violence, surgical procedures, or serious injuries.
    2. Content depicting violent confrontations or torture and killing of animals.
    3. Wishing harm, death, or illness upon others or promoting suicide or self-harm.
18. Bullying and Stalking
    Azizam requires users to respect others’ boundaries. Persistent harassment, stalking, or intimidation is strictly prohibited. This includes:
    1. Sending unwanted sexual content or objectifying messages.
    2. Sending intrusive chat messages multiple times without a response.
    3. Repeatedly visiting profiles despite being blocked.
    4. Creating new profiles to contact blocked users.
19. Coercion and Blackmail
    Coercive behavior and blackmail are prohibited. This includes:
    1. Threatening to publicly post revealing pictures unless demands are met.
    2. Extorting money or other benefits by threatening to share private images.
20. Misuse of the Reporting Feature
    Users are encouraged to report illegal or inappropriate content, but misuse of the reporting feature is not tolerated. Frequently submitting unfounded reports may lead to sanctions after a warning. Misuse is determined by the volume of unfounded reports within a certain period.

8. Obligations
   1. Truthful and Accurate Information
      1. Any information (e.g., data, images) included in the User’s account must be truthful and accurately reflect the User’s personality.
      2. Users must ensure they can be reached via the email address or phone number provided during registration. It is the User’s responsibility to keep this contact information up to date and to communicate with Azizam using the email address or phone number saved in their account. If the User communicates via a different email address, they must verify their identity to ensure the request is processed. Any delays caused by incomplete information will be the User’s responsibility.
      3. Users are required to provide only their own data (including email addresses and phone numbers) and are prohibited from using anyone else’s information, particularly with regard to financial details such as bank or credit card information for fraudulent purposes.
      4. Azizam reserves the right to verify the accuracy of the information provided by users to confirm their identity and ensure proper platform functionality. Upon request, users must verify their identity. Failure to comply with identity verification may result in the termination of the account without notice.
   2. User Conduct and Content, Granting Rights of Use
      1. By posting content on Azizam, Users grant Azizam a non-exclusive, territorially unlimited, sublicensable right to use their content for up to 60 months after account termination. This includes the rights to store, modify, and share content, as well as to use it in both modified and unmodified forms for commercial purposes, such as advertising Azizam. The rights granted include reproduction, distribution, public display, and communication rights across various media channels.
      2. Users are solely responsible for the content they post on Azizam and must ensure it complies with the Terms of Use. Azizam reserves the right to delete or block content that violates the Terms of Use or the Community Guidelines and may suspend or terminate accounts responsible for such content.
      3. The rights granted to Azizam include commercial and non-commercial usage, covering all current and future forms of media, including reproduction, distribution, public display, and database rights under Section 87b of the German Copyright Act. Azizam has the unrestricted right to use User content for advertising purposes and may modify or edit it as necessary. If User content is used outside the Azizam platform, the User will be credited as the author, using the profile name linked to their account.
   3. Messaging
      1. Users must adhere to the Terms of Use when sending messages and refrain from sending spam or inappropriate content. Azizam may monitor user messages for spam and use this data to improve spam detection.
      2. Users are responsible for regularly saving chat messages and attachments (e.g., images, voice messages). Messages and related content will be deleted after 60 months or upon account deletion.
   4. Profile and Security
      1. Users must create secure login credentials and avoid using passwords associated with other services. They are responsible for keeping their login information confidential and must change their credentials if they suspect unauthorized access.
      2. Users are liable for all actions performed using their account. Login details must not be shared with third parties, including family members or friends. Any misuse of the account must be reported to Azizam immediately.
      3. Users are responsible for regularly backing up their data.
   5. Verification and Due Diligence
      1. Azizam is not able to verify all details provided by other users, and the platform cannot guarantee the accuracy of the information shared by other users. Even if a user is marked as verified, it does not guarantee that all their details are correct. Users are responsible for exercising caution and verifying the accuracy of information before engaging with others through chats, meetings, or other interactions outside of the platform.
   6. Prohibition of Credit Farming
      1. Users are prohibited from making their profiles available for credit farming or participating in such activities. Credit farming includes the creation or use of accounts to collect free credits in a systematic way, especially through manipulation, deception, or exploitation of programming errors.

9. Sanctions for Infringement
   1. Azizam reserves the right to permanently remove User content that violates the Terms of Use. Users have no right to recover any content deleted by Azizam. Additionally, Azizam may report content that breaches criminal laws to the appropriate law enforcement authorities, as required by Regulation (EU) 2022/2065.
   2. If a User violates these contractual terms or the Terms of Use, Azizam may take appropriate actions based on the severity of the infringement. These actions include:
      1. Issuing a warning to the User.
      2. Temporarily blocking certain features of the Azizam platform for the User or restricting access to the User’s account.
      3. Permanently disabling specific platform features for the User.
      4. Permanently suspending the User’s account.
      5. Terminating the User’s account with immediate effect and banning the User from re-registering.
      6. Issuing a warning or blocking features will be considered a formal written warning.
   3. If a User continues to breach the Terms of Use despite previous sanctions or engages in criminal activity, Azizam reserves the right to terminate the User’s account for cause without prior notice.
   4. In cases where a User commits criminal offenses using their account, Azizam is entitled to immediately terminate the account without prior notice.
   5. If Azizam terminates an account due to reasons for which the User is responsible, the User is liable for compensating any damages caused.
   6. Users who (1) misuse the Azizam platform for prohibited commercial or business purposes, (2) send prohibited messages, (3) misrepresent their identity, or (4) impersonate another person, will be required to pay Azizam a contractual penalty of €4,000. This does not preclude Azizam from pursuing additional legal claims.

10. Liabilities
    1. Liability of the User
       1. If the User willfully or negligently violates their obligations under the Terms of Use, they are liable for any damages caused to Azizam or to Azizam’s legal representatives or agents.
    2. Liability of Azizam
       1. Azizam’s liability, regardless of the legal grounds, is limited to cases where:
          1. Damage arises from a culpable breach of a cardinal or essential duty, endangering the fulfillment of the contractual purpose.
          2. The damage is due to gross negligence or willful misconduct on the part of Azizam. If Azizam is liable for breaching an essential contractual duty without gross negligence or willful intent, liability is limited to the foreseeable damages typically expected at the time of contract conclusion, based on the information available to Azizam at that time. This also applies to damages caused by gross negligence or willful intent by employees or agents of Azizam, provided they are not managing directors or senior executives. Liability for indirect damages, such as loss of profit or third-party claims, is excluded unless caused by willful intent or gross negligence by Azizam.
       2. Claims for compensation under the German Product Liability Act, or for damages resulting from injury to life, body, or health, are not subject to the above limitations and remain unaffected.
       3. Azizam is only liable for the loss or recovery of data and programs if the loss could not have been prevented through reasonable precautions, such as creating regular backups of data and programs.
       4. Azizam is not liable for content posted by other users unless Azizam was aware of the unlawfulness of such content.
       5. The above limitations of liability also apply to Azizam’s legal representatives and agents.

11.  Changes to These Terms and Conditions and/or Services
    1. Azizam reserves the right to modify these Terms and Conditions and/or the platform services, or any part thereof, if such changes are objectively justified or necessary due to legal, regulatory, or security reasons. Changes may be required to address new technological developments, enhance security (e.g., in response to evolving technical issues or risks that may impact the platform’s services or systems), improve existing features, or introduce new ones. These changes ensure the platform remains functional and secure in line with these Terms.
    2. Updates required to maintain compliance with contractual obligations will not be considered changes to the platform.

12. Applicable Law, Place of Jurisdiction, Special Regulations for Users Outside of Germany
    1. The contractual agreements between the parties are governed by the laws of the Federal Republic of Germany.
    2. These Terms of Use do not limit the user’s right to rely on local mandatory laws or a jurisdiction that cannot be altered by contractual agreement. If any provision of these Terms is found to be invalid or unenforceable, it will be replaced by a valid and enforceable provision that closely aligns with the economic intent of the original provision.
